These Terms of Service ("Terms") govern use of iSwim, the staff management application, the family portal and related applications (the "Platform"), operated by Lane 4 Enterprises Pty Ltd (ABN 27 652 766 839), trading as iSwim ("Lane 4", "we", "us").

By creating an account or using the Platform you agree to these Terms. Our Privacy Policy explains how personal information is handled on the Platform.

1. Who may use the Platform

  • Guardians and adult members must be at least 18 years old, or the lower minimum age your Organisation sets, and use the Platform in respect of their own family.
  • Students generally do not hold accounts; where an Organisation issues a student account, a parent or guardian remains responsible for it unless the student is an adult.
  • Staff use the Platform under the authority of their Organisation, which controls their roles and access.
  • You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account and must tell us or your Organisation promptly about any suspected unauthorised access.

2. Your Organisation and us

The Platform is provided to your swimming Organisation, which decides who has access to it and what they can do. If your Organisation stops using the Platform, or ends your access, your access ends.

Your membership, enrolments, fees, refunds, class rules, camp rules and code of conduct are matters between you and your Organisation. We provide the software; we are not a party to your membership and do not set your Organisation's policies or prices.

Where these Terms and an Organisation's own published terms both address a matter between you and the Organisation, the Organisation's terms govern that matter.

3. Bookings, enrolments and camp registrations

  • Information you submit through the Platform (bookings, enrolment requests, forms) is relied on by your Organisation. You agree to provide accurate and current information.
  • A camp or event registration is complete when the Platform confirms submission. What you submitted, including any declarations you agreed to, is recorded as at the moment of submission and does not change if forms or records are later edited.
  • Registration windows, capacity limits and eligibility rules are set by your Organisation, and the Platform enforces them; a submission outside those rules may be refused.

4. Medical and emergency information: your responsibilities

Some Platform features exist to keep students safe at classes, camps and events. Where you provide medical, doctor, insurance or emergency contact information:

  • you confirm you are entitled to provide it: that you are the student's parent or legal guardian, or otherwise authorised;
  • you agree to keep it accurate and current, and to update it (or tell your Organisation) if it changes before an event: supervising staff rely on what the Platform holds;
  • please record it in the medical and emergency fields provided, not in free-text notes or messages, so it gets the protections described in the Privacy Policy;
  • you acknowledge that where a camp requires certain information to be on file before submission, that requirement comes from your Organisation's duty of care, and the Platform will enforce it;
  • pre-filled information is offered for your review; confirming or submitting it is your attestation that it is correct at that time.

Declarations presented on camp forms (consents, acknowledgements, terms specific to the event) are between you and your Organisation. The Platform records the wording you agreed to and when.

5. Payments

  • Payments made through the Platform are processed by your Organisation's payment provider (Stripe or Square). Your card details are provided directly to that provider and are not stored by the Platform.
  • The merchant for any payment is your Organisation. Pricing, receipts, refunds and disputes are between you and the Organisation, subject to the provider's terms; we will assist the Organisation with transaction records where needed.
  • We are not a bank, payment provider or money transmitter, and we never hold your funds: money moves between you, the payment provider and your Organisation.
  • Nothing in this section limits your rights under the Australian Consumer Law against the relevant supplier.

6. Acceptable use

You must not:

  • access or attempt to access information about families other than your own (for guardians) or beyond your role (for staff);
  • share your account or circumvent access controls, rate limits or security measures;
  • upload unlawful, infringing or harmful content, or content about a person (including photographs of a child) without the right to do so;
  • use the Platform to send spam or unsolicited marketing;
  • interfere with the Platform's operation, probe or scan it for vulnerabilities without written authorisation, or introduce malicious code;
  • scrape, harvest or bulk-export personal information other than through features provided for that purpose.

We may suspend or restrict access to protect the Platform, its users or their information, and will restore it when the risk is resolved.

7. Content and intellectual property

  • The Platform, its software and design are owned by Lane 4 or its licensors. We grant you a non-exclusive, non-transferable right to use the Platform for its intended purpose while these Terms apply.
  • Content you or your Organisation submit remains yours or the Organisation's. You grant us the licence needed to host, process, display and transmit that content in order to operate the Platform, and for no other purpose.
  • Feedback you give us about the Platform may be used to improve it without obligation to you.
  • If you believe content on the Platform infringes your rights (including copyright or a photograph of your child used without authority), report it to the contact in Section 12 and we will investigate and act promptly.

8. Availability and changes to the Platform

  • We aim for high availability but the Platform is provided on an "as available" basis: maintenance, upgrades and events beyond our control may interrupt service. Where practicable we schedule maintenance outside peak usage and give Organisations notice.
  • We improve the Platform continuously and may add, change or retire features. If a change materially reduces functionality an Organisation relies on, we will give the Organisation reasonable notice.

9. Disclaimers and liability

  • Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) or other law that cannot lawfully be excluded.
  • Subject to that: the Platform is a record-keeping and administration tool. It does not provide medical advice, and it does not replace your Organisation's duty of care, supervision practices or emergency procedures. Decisions made by Organisations and their staff, including decisions informed by information held in the Platform, are theirs.
  • To the extent permitted by law, we exclude liability for loss arising from inaccurate or out-of-date information supplied by users or Organisations; from unauthorised account access caused by credential sharing or misuse; and for indirect or consequential loss.
  • Where the law implies a guarantee that cannot be excluded but allows our liability for breaching it to be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
  • Otherwise, to the extent permitted by law, our total liability to you in connection with the Platform is limited to the greater of AUD $100 and the amount (if any) you paid us in the 12 months before the claim arose.

10. Termination

  • You may stop using the Platform at any time; guardians may ask their Organisation to close their family's access.
  • We may suspend or terminate access for material breach of these Terms, where required by law, or where an Organisation's agreement with us ends.
  • After termination, information is retained and deleted in accordance with the Privacy Policy and the Organisation's record-keeping obligations.

11. General

  • Governing law: the laws of Victoria, Australia; courts of that State have non-exclusive jurisdiction.
  • If part of these Terms is unenforceable, the rest continues.
  • A failure to enforce a term is not a waiver.
  • Changes to these Terms. We may update these Terms. We will tell you about a material change by email or a notice in the Platform at least 30 days before it takes effect, unless a change is needed sooner to comply with the law or to protect the Platform's security. A change does not apply to anything that happened before it takes effect. If you do not agree with a change, you can stop using the Platform and ask your Organisation to close your access; if you keep using the Platform after the change takes effect, you accept it. The current version is always available on the Platform.
